51 Foundation is committed to the privacy of its website visitors and the users of its products and services. This privacy policy (this “Policy”) describes the collection of personal information and certain other information by 51 Foundation, Inc., a Delaware non-profit corporation (“51 Foundation,” “we,” or “us”) from users of our website at www.51 Foundation.com (the “Site”), as well as all applications, devices, widgets, software, tools, and other services provided by us and on which a link to this Policy is displayed (collectively, together with the Site, our “Services”). This Policy also describes our use and disclosure of such information. If you choose to use our Services, you consent to the collection, use, and disclosure of information in accordance with this Policy. This Policy is incorporated by reference into and subject to the provisions of the 51 Foundation Terms of Use. The terms “you,” “your,” and “user” refer to the user visiting the Site or accessing or using the Services. Other capitalized terms used but not defined in this Privacy Policy have the meanings given to them in 51 Foundation’s Terms of Use.

What Types of Information Do We Collect?

Non-Personal Information

When you interact with our Site, we receive and store certain personally non-identifiable information. This type of information, which is collected passively using various technologies, cannot be used to specifically identify you.   

In addition, we may place a certain type of information on your computer to allow us to identify you, commonly referred to as a “cookie.” By showing how and when our visitors use this Site, this information can help us improve our Site on a continual basis. For instance, our Site may set a cookie on your browser that allows you to access the Site without needing to remember and then enter a password more than once during a visit to the Site. In all cases where we use cookies, we will not collect Personal Data except with your permission. We will only use cookies to view information on your hard drive that was put there by a cookie from 51 Foundation. If you do not wish to receive cookies, or want to be notified when they are placed, you may set your browser to do so, if your browser allows it. If you choose not to accept our cookies, you will not be able to use all of the features of the Site.

Personal Data

In order to answer your questions or fulfill your requests, we may need to ask you for personal information such as your name, address, email address and telephone number (“Personal Data”). If you are applying for a job with us, Personal Data also includes any resumes you send us in order to evaluate your potential employment. By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Policy. If you provide Personal Data, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of 51 Foundation and the authorized third parties referred to herein. We may keep all information in an off-line form, for archival purposes or as otherwise required by law.

51 Foundation will on its own initiative, or at your request, replenish, rectify or erase any incomplete, inaccurate or outdated Personal Data. You can update your contact information by e-mailing info@51 Foundation.com with the subject line heading of “Privacy Policy Request.”

Exclusions

This Policy does not apply to any Personal Data collected by 51 Foundation other than through the Site. This Policy also does not apply to any unsolicited information you provide to 51 Foundation through this Site or through any other means. Unsolicited information includes, but is not limited to, any ideas for new products or modifications to existing products and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information is deemed to be non-confidential, and we are therefore free to reproduce, use, disclose, distribute and exploit such Unsolicited Information without limitation or attribution.

How Do We Use The Information We Collect?

Non-Personal Information

Any non-personal information we collect, whether through cookies or otherwise, may be used and pooled with other information to track, for example, the total number of visitors to our Site, the number of visitors to each page of our Site, the domain names of our visitors’ internet service providers, and how our users use and interact with the Site. We may provide aggregate statistics about our customers, traffic patterns and related site information to reputable third parties, but these statistics will include no personally identifying information.

Personal Data and Device and Network Information

51 Foundation uses the Personal Data you provide in a manner that is consistent with this Policy. If you provide Personal Data for a certain reason, we may use the Personal Data in connection with the reason for which it was provided. For instance, if you contact us by e-mail, we will use the Personal Data you provide to answer your question or resolve your problem. 

51 Foundation and its subsidiaries and affiliates may also use your Personal Data to (i) provide the Services, (ii) to improve the content and functionality of the Site or the Services, or (iii) to contact you to tell you about services that may be available in the future. If we do contact you directly, each communication we send you will contain instructions permitting you to “opt-out” of receiving future communications. In addition, if at any time you do not wish to receive any future communications, if you wish to have your name deleted from our mailing lists, please contact us by e-mailing info@51 Foundation.com. 

If 51 Foundation intends to use any Personal Data in any manner that is not consistent with this Policy, you will be informed of such anticipated use prior to or at the time at which the Personal Data is collected.

Disclosures of Your Personal Data and Other Information

51 Foundation is not in the business of selling your information, and we do not sell our customer lists or any Personal Data you have disclosed to us to third parties. We consider this information to be a vital part of our relationship with you. We may, however, disclose information to certain third parties if you consent to us doing so, as well as in the following specific circumstances:

Business Transfers: Information about our users, including Personal Data, may be disclosed and otherwise transferred to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of company assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which Personal Data is transferred to one or more third parties as one of our business assets.

Agents, Consultants and Third Parties: 51 Foundation, like many businesses, may hire other companies to perform certain business-related functions. Examples of such functions include mailing information, maintaining databases and processing payments or to support the technical operation and maintenance of our Services and our Site. When we employ another individual or company to perform a function of this nature, we only provide them with the information that they need to perform their specific function.  

To Protect our Interests:  We also may disclose Personal Data and other information if we believe that doing so is legally required or is in our interest to protect our property or other legal rights (including, but not limited to, enforcement of our agreements) or the rights or property of others, or otherwise to help protect the safety or security of our Services or other users of the Services.

Security

51 Foundation has taken appropriate measures, including a combination of industry-standard security technologies, procedures, and organizational measures, to prevent unauthorized access to and the improper use or disclosure of your Personal Data. However, no Internet, e-mail or other electronic transmission is ever fully secure or error free, so you should take special care in deciding what information you send to us in this way.

Do Not Track

We currently do not participate in any “Do Not Track” frameworks that would allow us to respond to signals or other mechanisms from you regarding the collection of your Personal Data.

Children

51 Foundation does not knowingly collect Personal Data from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided Personal Data through this Site, please contact us, and we will endeavor to delete that information from our databases.

International Visitors

Many of our servers and data centers are located in the United States. If you choose to use the Services from outside the U.S., then you should know that you may be transferring your Personal Data outside of your region and into the U.S. for storage and processing. By providing your Personal Data to us through your use of the Service, you agree to that transfer, storage, and processing in the U.S. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Services. You should know that each region can have its own privacy and data security laws, some of which may be less stringent than those of your own region.

If you continue to use the Site or submit Personal Data after we publish any changes or revisions to this Policy, you will be deemed to have agreed to the new terms.
